ACADEMY PANEL URGES NATIONAL STRATEGY TO DEAL WITH PREEMPTIONS OF STATE AND LOCAL POWERS

Washington, DC — July 5, 2006— Increasing federal preemptions of state and local responsibilities, authorities and revenue sources require a new strategy involving stakeholders at every level of government, according to a report issued by a National Academy of Public Administration panel.

Prepared for the National Governors Association, Beyond Preemption: Intergovernmental Partnerships to Enhance the New Economy highlights complex issues that preemptions create and includes practical recommendations for our nation's leaders to explore.

The Academy panel found that federal preemptions and the imposition of unfunded mandates are increasing and likely to continue. Against this backdrop, the panel urged that federal preemptions be used only as a last resort with intergovernmental partnerships emphasized as an alternative.

The panel recommends a new strategy that includes:

  • official hearings at the national, state and local levels to reexamine continually evolving roles of federal preemptions and intergovernmental partnerships
  • preparation and consideration of actionable intergovernmental impact assessments by Congress and federal agencies prior to making decisions that affect state and local governments
  • a new Intergovernmental Partnership Act to strengthen and broaden procedures for managing the forces that lead to federal preemptions and mandates
  • a new Federalism Action Plan developed and implemented by the national associations of state and local officials working together
  • a new Federalism Research Agenda to be pursued jointly by the federal government and a coalition of state and local government officials

Academy Experts Recommend Strategies for Managing Effectively in Post-9/11 World

"The events of September 11, 2001 revealed serious deficiencies in government organization, systems and management. National Academy of Public Administration Fellows recommend strategies to manage effectively in a post-9/11 world in Meeting the Challenge of 9/11: Blueprints for More Effective Government, published this month.

The book, edited by Fellow Thomas H. Stanton, tackles a wide range of issues, including designing an organization that provides a strong government capacity to deliver services citizens need and deserve; making the Undersecretary for Management a key linchpin in bringing DHS functions together; restoring the President's capacity to manage effectively; using the imperative of national security to improve federal, state and local relations especially with critical services like police, fire and health; capitalizing on tested and proven management strategies to surmount new and upcoming challenges for our nation; sorting through constitutional alternatives for holding government contractors accountable for the work they perform; and transforming military personnel system policies to avoid staffing crises during the War on Terror.
